APM Solutions – Terms and Conditions of Sale
1. Introduction
These Terms and Conditions of Sale ("Agreement") govern the sale of 3D printed products and related services by APM Solutions ("Seller," "We," "Us") to the customer ("Buyer," "You"). By placing an order with us, you agree to these terms.
2. Definitions
- "Product" – Any manufactured, printed item or related service provided by APM Solutions.
- "Custom Order" – A product designed or modified according to the Buyer’s specifications.
- "Intellectual Property" – Any 3D model, design, or file, whether provided by the Seller or Buyer.
3. Orders & Acceptance
- All orders are subject to acceptance by APM Solutions.
- Custom orders require written confirmation and may require a deposit before production begins.
- APM Solutions reserves the right to refuse or cancel any order at its discretion.
4. Pricing & Payment
- Prices are listed in USD ($) and are subject to change without notice.
- Full payment is required before production starts unless otherwise agreed in writing.
- Accepted payment methods: Credit Card, PayPal, Bank Transfer, or other agreed-upon methods.
- Late payments may incur additional fees.
5. Production & Lead Times
- Estimated production times are provided at the time of order but are not guaranteed, these may fluctuate within 20% of provided timeline.
6. Shipping & Delivery
- Shipping costs are calculated at checkout or quoted separately.
- The risk of loss transfers to the Buyer once the product is shipped.
- APM Solutions is not responsible for delays caused by shipping carriers.
7. Quality & Warranty
- We strive for high-quality products, but minor imperfections (e.g., layer lines, small variations) are inherent in 3D printing.
- If a product is defective due to a production error, the Buyer must notify APM Solutions within 7 days for a replacement or refund.
- Custom orders are non-refundable unless the defect is due to an error by APM Solutions.
8. Returns & Cancellations
- Standard (non-custom) products may be returned within 14 days if unused and in original condition.
- Custom orders are non-refundable and non-returnable once production has started.
- Cancellations before production may be subject to a cancellation fee.
9. Intellectual Property
- Buyer-Provided Designs: The Buyer retains ownership of any designs they provide. However, APM Solutions is not responsible for copyright or patent infringements related to these files.
- APM Solutions’ Custom Designs: Any designs created by APM Solutions remain its intellectual property unless otherwise agreed in writing.
10. Liability & Indemnification
- APM Solutions is not responsible for damages, injuries, or losses resulting from the use of its products.
- The Buyer agrees to use the products responsibly and in compliance with all applicable laws and safety guidelines.
11. Confidentiality & Privacy
- We respect your privacy and will not share personal information except as required to complete your order or comply with legal obligations.
12. Force Majeure
- APM Solutions is not liable for delays or failures caused by events beyond its control, including but not limited to natural disasters, supply chain disruptions, or technical failures.
13. Governing Law & Dispute Resolution
- This Agreement is governed by the laws of the State of Connecticut, USA.
- Any disputes shall first be attempted to be resolved through negotiation. If unresolved, disputes will be handled through arbitration or mediation in Connecticut.
14. Amendments & Updates
- APM Solutions reserves the right to update these Terms and Conditions at any time.
- The latest version will be available on our website and will apply to all future transactions.
